Conditions of use

1. Scope of validity

These Amodeo Design | Web&Graphics - Brand Terms and Conditions (hereinafter "Amodeo DESIGN | Web&Graphics" or "Web&Graphics") apply to the use, by a customer or user (hereinafter "user"), of the services and products offered in direct sale on the website www.webandgraphics.ch or subsequently to a personalized offer.

By using the services, the user accepts these Terms of Use in their updated version.

2. Web&Graphics services


2.1. In general

The services, in terms of content and form, can be modified, expanded or suspended by Web&Graphics at any time.

Product descriptions, offers, prices and similar published by Web&Graphics on services can be modified (i) by Web&Graphics at any time and, unless otherwise agreed between Web&Graphics and the user, are not binding.

Web&Graphics takes appropriate measures to use timely and correct data in its services. The data may, however, contain errors or incomplete information due to technical or other circumstances. The user is not entitled by Web&Graphics to derive any rights from this.

Web&Graphics undertakes to guarantee a high level of availability of the services offered, but does not assume any guarantee for uninterrupted and fault-free operation of the services. Web&Graphics undertakes to remove technical defects within their respective areas of competence within an appropriate period.

The user does not claim against Web&Graphics any right to use the services or services of third parties.

2.2. Registration, user account

The use of services may require registration or creation of a user account. Registration or opening of a user account is granted only to users provided with the exercise of civil rights (natural and legal persons). The user is obliged to provide complete and correct information, as well as to modify it promptly if they are no longer current. You are solely responsible for the content of your registration and therefore for the information it provides about itself. Web & Graphics is not required to verify the correctness and completeness of such information.

The login in the user account is carried out with the access data generated during registration (user name / password) or through a third-party platform chosen by the user, respectively an Identity Provider. Web&Graphics can consider legitimate any access made with the correct access data (username / password) or authenticated access by an Identity Provider. Web&Graphics has the right, for legitimate reasons, to refuse a login, delete a user account or limit access. However, the contents and information shared through the user account can continue to be shown on the Web&Graphics services or on third-party platforms.

Web&Graphics establishes the type of access protection and adopts measures designed to protect its services from unlawful interventions by third parties. Despite this, protection is not absolute. Web&Graphics is not required, for example, to take measures against copying.

The user is obliged to treat his access data with confidentiality and to protect them from abuse. The user can not claim any claim against Web&Graphics for an abuse of the access data or for damages that derive from an abusive access in the user account and from the use of the services. If the user ascertains the presence of abuses or other offers and illegal contents or presumes their existence, he must immediately notify Web&Graphics (This email address is being protected from spambots. The user account or related rights cannot be transmitted or transferred by the user.

2.3. Publication of content

The user can record and modify his own registration and possibly additional content, such as images, texts, videos, referrals to websites, other multimedia contents (collectively "contents"). Furthermore, certain services allow the user to register, publish and adapt additional content (such as comments and evaluations). The conditions for registration accepted by the user at the time of the creation of the registration are applicable. If the contents concern enrollments regulated by law, Web&Graphics reserves the right to verify that the contents correspond to the Conditions for registration and the applicable legal provisions (telecommunications law and related ordinances), to correct such contents and eventually to reject modifications of the user.

The user declares to accept the online publication and publication of such content on services, in the press, as well as on partner and third-party platforms and gives Web & Graphics the rights necessary for this purpose. Where, how and if such content is published is at the discretion of Web&Graphics.

The user can adjust incorrect or non-current content. In this regard, the user undertakes to make the content available in a timely and technically appropriate manner. The user assumes the risk of transmission. If content cannot be published or is published incorrectly due to the fact that the content was not provided promptly or was provided in a defective or incorrect manner by the user, the user cannot make any claim against Web&Graphics .

Web&Graphics can refuse, modify or cancel at any time, at its own discretion and without indicating the reasons, the user's contents due to their concrete content, their origin, technical form or quality, especially if the contents are not compliant to the guarantees referred to in point 4. The user cannot make any claim against Web&Graphics due to the refusal, modification or deletion of a content.

The contents that are published on the services express the subjective point of view of the users and not the opinion of Web&Graphics. The publication also does not include the approval of or the consent of Web&Graphics to the contents shown. Web&Graphics is not required to verify the contents and assumes no guarantee for the correctness of the same.

3. Third-party services

Web&Graphics can integrate third-party services into its services. Some service functions may include, for example, interactions between the user and third parties or related services. The services of third parties can thus allow, for example, the user to share content that will then be published on third party services.

The way in which the user interacts with these third-party services falls under his exclusive responsibility. Web&Graphics has no influence on the configuration of these third-party services and related content. You may not claim any rights against Web&Graphics arising from the use of such third party services.

4. User obligations

The user undertakes to use the services appropriately and to refrain from any improper, abusive and illegal use, eg the introduction of malicious software (such as viruses, worms or other espionage software). Furthermore, the services cannot be used in such a way as to adversely affect their availability for Web & Graphics or other users, or in such a way as to jeopardize their use in any other way (eg through the use of automatic devices, scripts and robot services , spider, crawler or scraper).

The user guarantees that the contents recorded by him, published or otherwise provided in relation to the services, do not violate legal provisions, third party rights or morality. The user undertakes, in particular, not to publish content that violates the rights of third parties, competition law, confidentiality obligations or be defamatory, racist, violent, radical, threatening, contemptuous, pornographic or obscene and not to violate any rights of third parties (such as copyright, trademark and commercial company rights). Web & Graphics is authorized to block or cancel promptly and without notice or not to publish content that violates these rules.

5. Intellectual property

The user acknowledges that the services, the services of third parties and the contents published by Web&Graphics, by third parties or by other users on the services, are normally legally protected and that their use requires the authorization of the respective right holder. Reproduction, transmission (electronically or by other means) or complete or partial modification of services or contents is not permitted.

The copying, downloading or printing of services or content is permitted only for personal, non-commercial use, to the extent that any copyright notices or other legally protected indications are removed.

6. Data protection

The Web&Graphics data protection disclosure is in its updated version which is available in the relevant service and on www.webandgraphics.ch

Web & Graphics can provide the user with information on other Web & Graphics products or services (eg in the form of a newsletter or by letter). Should the user no longer wish to receive such communications from Web&Graphics, he may cancel the registration at any time by e-mail to This email address is being protected from spambots. 7. Responsibility

To the extent permitted by law, Web&Graphics disclaims any responsibility towards users in relation to the use of the services. The user acknowledges in particular that Web&Graphics is not responsible for the content posted on the services by other users or the contents of other websites and mobile apps to which the services refer. Nor does Web&Graphics answer for third-party services.

The user undertakes to keep Web&Graphics completely free from any third-party claim due to failure to comply with these Terms of Use.
 

8. Failure to comply with the Terms of Use

In the event of failure to comply with these Terms of Use, Web&Graphics is authorized to block or refuse access to services to a user.
 

9. Final provisions

Web&Graphics reserves the right to modify the Terms of Use from time to time. The updated version can be consulted at www.webandgraphics.ch

These Terms of Use are governed by Swiss law, with the exclusion of the rules of private international law.
